Terms & Conditions

These terms govern your use of www.oxylanedigital.co.zm and related enquiry channels operated by Oxylane Digital Solutions Ltd. (“ODSL”, “we”, “us”). By using the site you agree to them.

1. Acceptance and related policies

By accessing or using this website you confirm that you accept these terms and that you agree to comply with them. If you do not agree, you must not use the site.

2. What this website is for

This site presents Oxylane Digital Solutions Ltd., our capabilities (including USSD, SMS, web and related platforms), and ways to reach us. Unless we expressly agree otherwise in writing, nothing on this site constitutes an offer to supply services or a binding contract.

Descriptions, screenshots, and examples are for illustration. Commercial terms for any engagement are set out in separate agreements, statements of work, or order forms.

3. Acceptable use

You agree not to:

  • Use the site in any way that violates applicable law in Zambia or your own jurisdiction.
  • Attempt to gain unauthorised access to our systems, accounts, or data; or probe, scan, or test the vulnerability of the site without permission.
  • Introduce malware, excessive automated traffic, or anything that could impair the site’s operation or security.
  • Scrape, harvest, or extract data from the site at scale without our prior written consent.
  • Use the site to send unsolicited bulk communications or to misrepresent your identity or affiliation.

We may suspend or block access where we reasonably believe these rules are breached.

4. Intellectual property and licence to browse

Unless stated otherwise, ODSL or our licensors own the copyright, trade marks, and other intellectual property in the site and its content. You receive a limited, revocable, non-exclusive licence to view and temporarily download pages for personal, non-commercial use in line with these terms.

You must not copy, republish, sell, rent, adapt, or exploit site content for commercial purposes without our written permission, except where fair dealing or similar exceptions apply under law.

5. Enquiries and communications

When you submit information through our Contact Us form or other channels we provide, you warrant that the information is accurate to the best of your knowledge and that you are authorised to contact us.

You grant us a licence to use submissions for the purpose of responding to you, improving our services, and protecting our legitimate interests, in accordance with our Privacy Policy.

6. Third-party sites and services

The site may link to third-party websites or embed third-party tools (for example maps or analytics). We do not control those services. Their terms and privacy notices apply to you when you use them. We are not responsible for their content or availability.

7. Disclaimer and limitation of liability

The site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the extent permitted by law, ODSL and our directors, employees, and agents will not be liable for any indirect, consequential, or special loss, or for loss of profits, revenue, goodwill, data, or business opportunity arising from your use of the site. Our total aggregate liability arising out of or in connection with the site (other than liability that cannot be limited under applicable law) shall not exceed the amount you paid us specifically for access to this website in the twelve months preceding the claim, or where no such payment exists, ZMW 500.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under Zambian law.

8. Indemnity

You agree to indemnify and hold harmless ODSL and our officers, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these terms or your misuse of the site, except to the extent caused by our wilful misconduct or gross negligence.

9. Changes, suspension, and law

We may update these terms from time to time. The “Effective” date at the top of this page will change when we do. Continued use after changes constitutes acceptance of the revised terms.

We may suspend or withdraw the site or any part of it. These terms are governed by the laws of the Republic of Zambia. The courts of Zambia have non-exclusive jurisdiction over disputes relating to the site, without prejudice to any mandatory rights you may have under consumer protection law in your country.
